These Terms of Service (“Terms”) govern your access to and use of the websites, applications, assessments, reports, and services provided by Precision Health Reports (“PHR,” “we,” “us,” or “our”) (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not access or use the Services.

1. Eligibility

The Services are intended for individuals who are at least 18 years of age. By using the Services, you represent that you meet this requirement.

2. Nature of the Services (Critical Section)

PHR provides diagnostic and informational health risk assessments based on information supplied by you and analytical models designed to evaluate cardiometabolic and related health risks.

PHR does not provide medical care, medical treatment, or medical advice.

The Services are not intended to diagnose, treat, cure, or prevent any disease, nor to replace consultation with a qualified healthcare professional of your choosing.

You acknowledge that:

  • Health risk assessments rely on available data and statistical models

  • Results may not account for all factors affecting your health

  • No guarantees are made regarding outcomes or results

You are solely responsible for decisions you make based on the information provided through the Services.

3. Relationship to Healthcare Providers

PHR may engage licensed healthcare professionals or consultants to support certain aspects of the Services, including review or oversight functions. However:

  • Use of the Services does not create a physician-patient relationship

  • PHR is not acting as your treating provider

  • Any medical decisions should be made in consultation with your chosen healthcare professional

4. User Accounts and Information

To access certain Services, you may be required to create an account and provide personal information, including health-related data.

You agree to:

  • Provide accurate and complete information

  • Keep your account credentials secure

  • Notify us of any unauthorized use of your account

You are responsible for all activity conducted through your account.

5. Consent to Data Processing

Your use of the Services requires the collection and processing of personal data, including health-related information, as described in our Privacy Policy.

By using the Services and completing required consent steps, you acknowledge and agree that:

  • Your information will be processed for the purposes described

  • Automated systems and algorithms may be used to generate personalized insights

  • Your data may be processed or stored in countries outside your country of residence

Specific consent is obtained at the point of assessment initiation.

6. Acceptable Use

You agree not to:

  • Use the Services for unlawful purposes

  • Submit false, misleading, or incomplete information

  • Attempt to reverse engineer, scrape, or interfere with the Services

  • Use the Services to provide medical advice to third parties

  • Violate applicable laws or regulations in connection with your use

We reserve the right to suspend or terminate access for violations.

7. Intellectual Property

All content, software, methodologies, reports, trademarks, and materials associated with the Services are owned by or licensed to PHR and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your personal or internal business purposes, subject to these Terms.

You may not reproduce, distribute, or commercially exploit the Services or their outputs without prior written permission.

8. No Guarantees; Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, PHR disclaims all warranties, express or implied, including but not limited to:

  • Accuracy or completeness of results

  • Fitness for a particular purpose

  • Non-infringement

  • Uninterrupted or error-free operation

9. Limitation of Liability

To the fullest extent permitted by applicable law:

PHR shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Services.

PHR’s total liability for any claim shall not exceed the amount you paid for the applicable Service giving rise to the claim.

Nothing in these Terms limits liability where such limitation is prohibited by law.

10. Indemnification

You agree to indemnify and hold harmless PHR and its officers, directors, employees, contractors, and affiliates from any claims, damages, or expenses arising out of:

  • Your use of the Services

  • Your violation of these Terms

  • Your misuse of information provided by the Services

11. Suspension and Termination

We may suspend or terminate your access to the Services at any time if:

  • You violate these Terms

  • Required consents are withdrawn

  • We are required to do so by law or regulation

Upon termination, provisions relating to intellectual property, disclaimers, and limitation of liability will survive.

Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction
